Guys here is a copy and paste from Simon Austin a reporter from The Bun who is pretty close to MC. Explains why we are not buying ER back atm and in my opinion this is about as close to the truth as we will get.

Why hasn't Cellino been able to buy back Elland Road?

Talking to Massimo Cellino over the course of 2014 has taught me that when he says 'the deal is done', he means 'the deal is agreed'.
Not that 'the deal has been signed', which is probably how you and I would interpret it.
This might seem insignificant, but it is an important distinction, as you'll see during the course of this post.
The distinction has been evident when the Italian has talked about transfers, incoming managers and most recently about the attempted buyback of Elland Road.
Back in August, I interviewed Cellino in the stands of the stadium for ITV Calendar.
On a sunny afternoon, he was bullish and buoyant and everything seemed good at Elland Road. Cellino announced that the terms of the share purchase agreement (SPA) with GFH had been renegotiated, essentially meaning that his debt to them was written off until the club reached the Premier League.
So he declared that the club was 'debt free'.
Cellino said all parties realised this was for the best of Leeds United. He would have more capital for the development of the team and purchase of the stadium and the club would have a better chance of reaching the Premier League.
For their part, GFH's stake would be worth a lot more if the club reached the promised land of the Premier League.
There were also suggestions of a disagreement between the parties about the state of the club's finances when it was sold to Cellino, and that this was a good way of avoiding legal action between the parties. A happy compromise.
Cellino also made his now infamous promise to buy back Elland Road 'by November'.
He had originally told me he would buy the ground back the day after his purchase went through in April, but that hadn't happened.
Fast forward to this week and we saw a very different Cellino. Beleaguered. tired and weary.
Now he conceded that he wouldn't be able to buy the ground back by November. In fact he probably wouldn't be able to buy it this year.
The exact reasons have been a little unclear, but I will try and shed as much light on them as I can.
Not only was Cellino a little hasty in promising to buy back Elland Road, he was also hasty in saying a deal had been done with GFH over the SPA.
In fact it hadn't been signed and it still hasn't.
Indeed GFH don't appear to have any intention of doing so. They want the original terms of the SPA to be honoured, including payment by Cellino of the next instalment due to them - in December and for about £6 million.
Perhaps GFH now realise that those hopes of the club getting into the Premier League were a little premature and will have to wait for at least another season.
I've tried to get a response from Salem Patel, via text and email, but received no reply.
Under the terms of the SPA, any substantive decision affecting GFH's shareholding must be ratified by a majority vote of the board, including one of the two GFH-nominated directors, Salem Patel and Salah Nooruddin.
They have been unwilling to ratify a purchase of the stadium involving a contribution commensurate with their shareholding.
GFH have countered by complaining that they thought the £10.75 million gained from the sale of Ross McCormack in the summer would be used to buy the ground.
And, in fairness to them, Cellino did say that himself.
Yet Leeds probably only received about £9 million from the sale of McCormack, as a portion went to his former club Cardiff. The Elland Road buyback is for £16 million.
In any case, the terms of the SPA do not require consultation with GFH over transfers. And would they really have vetoed the sale of a player they had agreed to sell to Cardiff for a fraction of that £10.75 million back in January?
So Cellino has been looking for a mortgage to make up the shortfall.
This has so far proved impossible though, mainly because of the club's poor credit rating, which was hardly helped by the winding up orders issued against it earlier this year.
So Cellino, who is even conservatively estimated to be worth £500 million, was left with a decision.
Pay 100% for an asset that will greatly increase the value of GFH's shareholding, yet to which they not contributed, or not?
The Italian has seemed reluctant to express it in such terms. He said buying the stadium outright could cause the club to fall foul of the Football League's financial fair play rules, yet I called them to check this, they said any spending on infrastructure or stadia was exempt from FFP.
That all seems a bit of a smokescreen.
Cellino has told me he hates breaking promises and letting the fans down, but that's unfortunately what has happened, for the time being at least.
The 58-year-old flies to Miami on Sunday to recharge his batteries and try to think of a solution to the current impasse over Elland Road.
My personal opinion, based on experience, is that this is a man who has good intentions for the club and is not there to enrich himself at the expense of Leeds United.
Yet he can be rash, in terms of both his decision-making and pronouncements, and that has come back to bite him once again.
Perhaps the introduction of a new communications adviser at Elland Road, Matt Child, will help.
For the time being we are left with a club still no nearer to owning its own stadium, which yesterday released a statement saying it aimed to 'stay in the Championship' this season.
That's all a far cry from those heady days when Cellino first took over.

there is a petition out at the moment requesting the FL to act in the best interests of LUFC and hounding MC is not.

Doesnt matter if your for or against MC only if you recognise that he is doing a better job for us than previous owners and if he was to be forced out we would be in a really bad place.

It is court transcript of him asking for more money. He would like his money upped from 500per week to 5500 per week living expenses while in jail.

lists include 500pw on phone calls
250 pw to pay for other inmates calls
500pw food and clothing. while in jail
the list goes on and the judge has none of it.

Also what comes to light is more details of the case against him and what his defence will be.

In short someone hacked his email account sent various emails and invoices plus requests asking companies to amend invoices all to be paid into his bank account and then use that money from his bank account all without his knowledge.

I know we have a legal type on this forum maybe they could look at it with better eyes than I and give their opinion

1.) LUFC Spain I think he already is in trouble being locked up in Dubai!

In my experience and my opinion Dubai is a false place and a bit odd, the normal people in hotels etc are great very helpful but you kinda get the feeling you don't want to do anything that may offend (even if by accident) or that would be it, you could be sent away for ages for not much, would not trust their justice system methinks.

As for DH if that is his defense then oh dear, mails/banks can be hacked but will be evidence of this sooooooo David not looking good.

Also how does anyone spend all that money in a month in jail!

I would not wish to be in his place no matter how much money he has, still he might lose a bit of weight now ha ha


2.) Having worked in Dubai and Abu Dhabi the rules are quite clear. They are to a certain extent 'liberal' countries, Dubai moreso than Abu Dhabi but God help you if you fall foul of the law. It is a very safe place to live (apart from their driving!) crime is practically non existant and if you obey the rules its a good a place as any.
However, flout the rules, break the law and bang, you're in prison. Guilty, innocent is irrelavent. You will be thrown in prison without a second glance and for how long is anyones guess. Could be a day, a week, a month or a year. They will let you go whenever they see fit.
Haigh will be going through hell over there and to be honest he could still be in there in five years time. Unless the Chief of Police has a change of heart!

Guys just wrote this article on MC think I got it about right? Posted it in the London economic after a real hack job on MC with a guy who started his report with 'I had a smirk on my face when I herd Cellino was to be banned' Fed up with negative press all the time.

After reading many accounts on how Massimo Cellino the owner of 75% stake in Leeds United is constantly made to be the pantomime bad guy, I thought it right to have a second view of him instead of a piece written by someone who has no idea of what he is doing at Leeds or the charges against him.

At the time of writing the football league have asked LUFC to suspend Massimo in 28 days, due to being found dishonest in a tax avoidance case in Italy. I think it only fair to look at this further. I am not going into any past convictions as they have no bearing on the topic of discussion today. The reason I say that is because of the rehabilitation of offender act says they are spent and I believe every person as the right to move on from past convictions and so does the law.

If we look at the case against him it is for unpaid tax on a yacht called 'Nellie'. So how did Massimo find himself in this position? Firstly he was a USA resident from his house in Miami. A Florida-based company, Freetime Miami owns the yacht and Massimo is a manager within this company. The company purchased the yacht and all taxes on the said yacht were paid in full to the USA.(in uk law this is the end of it and no charge could be applied to Massimo) After some time the yacht was sailed into the med and moored in Italy where he was allowed to keep the yacht for a period of time. Cellino said he had intended to have the yacht sailed back to the US but that its transfer had been held up by mechanical damage and as such the judge ordered it's confiscation due to it being in Italian waters longer than was allowed and charged Massimo with trying to avoid paying VAT which of course was paid in full in the USA.

He was in due course found guilty of trying to avoid VAT and fined 600k euros. He has appealed this and under Italian law has no conviction against him while the appeal process goes on. Under Italian law you are not guilty until you have exhausted your appeal rights.

This is the case against Cellino that the football league are perusing to ban him from owning a UK football club under the fit and proper person test as they argue he was dishonest.

To add to this some more under appeal against the football league the QC Tim Kerr agreed that this in itself was not dishonest and stated that until the full ruling from the court in Italy is seen he should be allowed to own Leeds Utd. The football league say they have now got a copy of the ruling and it implies he was dishonest which is why they have now moved to ban him from LUFC. It is also worth noting that Massimo Cellino could own and run any company within the UK legally, and his tax avoidance in Italy would have no bearing on it.

Now the football league fit and proper person test is to protect the club from dastardly persons who could damage the club and the football league is there to work in the best interests of the clubs within the league. This is very important as we need to look at those words 'work in the best interests of the club' when we look at what Cellino has done for LUFC.

Before he took over LUFC was loosing over 1 million a month and the parent company at the time GFH was unable or unwilling to service any debts to keep the club from administration. Cellino bank rolled the club to the tune of about 7 million prior to his takeover. If he had not done this the club would have fallen into administration. Upon taking over he went on a cost cutting exercise that was derided in the press and generally made the laughing stock of. He settled numerous winding up orders from HMRC to lawyers left by a previous owner Ken Bates. He then bought 15 new players who were a better standard for the most part then what we had previously. He bought players not on high wages but players who came on reduced wages with the incentive of good results equals more money. That in itself is a breath of fresh air. He sold Ross Mcormack who yes was our leading goal scorer but he sold him for close to 11million which for a Championship player must be some kind of record. He engages the fans, yes he is a little eccentric but who doesn't love an eccentric? On the 1st of December he announced a new cash injection of 20 million into LUFC using his own money not getting a loan and burdening the club further. He has stated that one of his goals is to by back Elland Road our stadium which was sold in 2006 to pay debts and Shaun Harvey (yes the same Shaun Harvey the football league chief exec) oversaw this sale and the consequent administration of LUFC.

So taking the football league mandate of working in the best interests of the club many are wondering how given his financial input, stability and investment in Leeds how could banning him for less than 77 days be in any way in the best interest's of Leeds Utd? His case is considered spent on the 15th of March 2015 and the league agree he will be able to carry on owning LUFC on this date.

Some background information should go along with this piece and it would be very remiss of me not to mention these.

When Ken Bates owned LUFC Shaun Harvey became our MD. This was after he had been the MD of Bradford seeing Bradford go into administration twice. When at Leeds he then presided over Leeds going into admin so we are talking about one who does not have the best record of running a football club, indeed he would probably fail the fit and proper person test that he is so using against one who can actually run a football club. The Ken Bates connection is a very interesting one as he stated when owner of Leeds and I quote
" I shall not rest until Leeds United are kicked out of the football league. There fans are the scum of the Earth, absolute animals and a disgrace. I will do everything in my power to make this happen".
Now we have Ken Bates colleague in a position of power within the football league being the CEO and Leeds seemingly been made an example of again. Previously we were docked an unprecedented 15 points for going into admin in 2007. This has never been given to any club before or since. This brings us fairly up to date with the football league again trying to ban our owner which has never happened before even with one owner of Birmingham being arrested, charged found guilty of money laundering and now resides in prison. Or a number of others with charges, convictions for rape, racism, embezzlement or financial mismanagement at best. Look at Blackpool and the turmoil they are going through but the football league do nothing. Ahh yes of course one of the owners of Blackpool are on the football league board who voted to try and ban Cellino.

So looking at the above are Leeds supporters paranoid or do we have some justification?

I think you'll find that other teams have been docked 15 points (and more) since Leeds got theirs. It goes up if you have been in admin more than once.

We'll explained luff Spain the FL has persecuted Leeds United for years you only have to read the book "No Glossing Over It" by Gary Edwards where all the incidents are well documented to see how they feel towards the club. I don't understand how they can act as judge and jury on matters which they have invested interest and how the likes of Shaun Harvey and Karl Oysten can call a kettle grimy arse when they are certainly not as white as snow. The FL needs to be run by independent people and sense might prevail, but that will never happen and they won't stop until they have Cellino out.

Johnny Giles now saying the fans want Cellino out and encouraging the League to get better lawyers to do it! Tellingly he says the moment Cellino told ex players they could be ambassadors and get free entry to games but nothing else turned his stomach!! That's the key point isn't it Johnny boy! Now feck off!


I love Giles but am totally pissed off with these comments. He makes a ten minute appearance on a radio show over here every Thursday. It's "off the ball" on Newstalk. I have sent loads of texts over the years about the bates regime with none read out. I urge you all to inundate the show with tweets, texts, e-mails etc for his slot asking him WHY he wasn't so out spoken when Bates was ripping the club. Show starts at 7 pm.

I keep saying it but NR has a dreadful record. Worse than Dave Hockaday and less experience. can't believe people are so happy to have a guy with 24% win ratio as coach. I really hope I will be eating my words but nobody seems to be thinking with their head everyone seems caught in the romance of it. He has had 9 games in charge of a championship side in total. He has only looked after 67 games in his life omfg this has car crash all over it. Really hope I am wrong.

Warnock is not good enough to play in the formation we now play. Yes he has had some great games for us defensibly but going forward he doesn't have the legs.

DM looks like he wants our L and R back up the field SW can't offer that. Beradi even out of position gets forward supports attack and gets back. Simples

Watching him speak about this I can see a court case against the FL and him winning. I just don't think the FL have seen a guy like this before. He will not roll over and the FL will brown themselves. There is nothing like this ever to happen before all their rules are untested in court let's see what a court injunction does to them.

On the up side I does seem to have brought our supporters together at one common enemy the FL. Be you for MC or against everyone now seems to be hands off our MC.

If a club wants to pay 10million plus for Mowatt, Cook or anyone else we would be mugs not to take it atm. However I just can not see MC selling anyone who wants to stay at LUFC. In fact hasn't he said time and again he will not sell our youth as they are needed when we are promoted next year.
